I, the participant / parent or legal guardian, understand that Active8Kids Trust activities involve some risks of injury. Some of the inherent risks include, but are not limited to falls, collisions with participants or stationary objects, landing wrong on jumps, landing on other participants, over-exertion, attempting actions that are beyond a participant’s capacity, and unexpected failure of equipment. Other inherent risks include careless behavior of the participant or supervisory or judgment error by Active8Kids Trust staff (e.g. staff misjudging the capacity of the participant to perform a task).

Furthermore I, the participant / parent or legal guardian, understand that minimal or serious injuries can occur in any physical activity. While it is impossible to eliminate all risk and possibility of injury, Active8Kids Trust 1) has designed the facility with safety as a prime concern; 2) provides padding of floors and many stationary objects; 3) has trained staff on duty; 4) provides instruction and emphasises safe skill progressions. 

I, the participant / parent or legal guardian, hereby assert that my participation (or that of my minor child) is voluntary and that I (and my child) knowingly assume all inherent risks.

In consideration of permission to use the Active8Kids Trust facilities and services, today and on all future dates, I, the participant / parent or legal guardian, on behalf of myself, my spouse, my heirs, my parents or guardians, personal representatives, and assigns [hereafter referred to as Releasing Parties] do hereby release, waive, discharge, and covenant not to sue Active8Kids Trust, its owners, directors, officers, sponsors, affiliates, employees, volunteers, independent contractors, equipment providers, agents, and facility owners [hereafter referred to as Protected Parties] from liability from any and all claims arising from the ordinary negligence of Active8Kids Trust or the Protected Parties. This agreement applies to 1) personal injury (including death) from incidents or illnesses arising from participation in Active8Kids Trust activities (including, but not limited to, instruction, individual or group play, parties, classes, school holiday programs, special events, use of Active8Kids Trust facilities or equipment.) I authorise any representative of Active8Kids Trust to consent to and/or authorise any medical attention, treatment, surgery or administration of drugs by qualified and licensed medical professional for myself or my child, should it be necessary.

I, the participant / parent or legal guardian, understand Active8Kids Trust produces promotional materials. I understand that I/my child may be included in videotape or photography taken at Active8Kids Trust. I hereby grant Active8Kids Trust, its successors, assignees, licensees, sponsors, any television networks and all other commercial exhibitors the exclusive right to photograph and/or videotape myself/my child and further to utilise my/my child's name, face, likeness, voice and appearance as part of the event, and in advertising and promotion of the event.
